Unlimited Massage Membership Agreement

I do hereby agree of my own free will to the terms of this contract entered into between myself and NOURISH, Nourish Incorporated. For the consideration of 1 month of unlimited Massages at NOURISH, at 130 Walnut Avenue, Santa Cruz, CA, I agree to pay NOURISH, Nourish Incorporated, or its agents and heirs the sum of $65.00 per calendar month. This payment will be charged to my credit card on the agreed date. I understand that I will be responsible for this charge regardless of how often I utilize this Unlimited Massage Enrollment. This contract automatically renews on a month to month basis, meaning that I will have unlimited use of Massage at NOURISH for each month and I will continue to be charged $65 per calendar month. I understand that this Unlimited Massage Enrollment at NOURISH may not be used by any other person or persons and that I am solely responsible for its use. I also agree that Unlimited Massage Enrollment eligibility is based upon the contingency of my Membership in good standing with NOURISH, Nourish Inc. I agree to all terms of this Membership regardless of my Unlimited Massage Enrollment status.

I acknowledge that this Unlimited Massage Enrollment will give me access to unlimited massages at NOURISH, 130 Walnut Avenue, Santa Cruz, CA only during the published available massage hours. I may advance book up to 1 massage appointments per month. All other visits may only be booked on the business day in which the massage is received. I also accept that if I knowingly and willfully advance book 2 or more massage appointments within a 30 day period I will be charged an ADDITIONAL FEE of $65 for each booked massage appointment.

I accept that the Unlimited Massage Enrollment and its corresponding charges may only be frozen, stopped, transferred, or any other changes made to this agreement in writing, with 30 days advance written notice. When freezing this Unlimited Massage Enrollment I will provide in writing with 30 days advanced notice the dates upon which to ÒfreezeÓ and ÒrestartÓ this Unlimited Massage Enrollment and agree that the charges agreed to in this contract will resume on the ÒrestartÓ date. I may cancel this contract with 30 business days written notice. I accept that freezing or canceling my Unlimited Massage Enrollment does not in any way affect the status of my NOURISH membership. I agree that NOURISH, Nourish Incorporated, it agents or heirs may at anytime, for any reason, cancel this contract verbally or in writing.

I agree to keep the credit card used for this transaction in good standing. If any charge is declined, I will forfeit the use of the Unlimited Massage Enrollment and will provide immediate payment from another source upon request. I will also pay a penalty of $25.00 for every declined transaction. Any change to the credit card used for payment must be made in writing at least 14 business days before the next transaction and that change of card does not constitute any other change in this contract.

I knowingly, voluntarily, and expressly waive any and all claims against NOURISH, Nourish Incorporated, their agents, and their heirs that may result from any and all injuries and/or damages that I sustain as a result of any and all activities that I participate in at 130 Walnut Avenue, Santa Cruz, CA. I, my heirs, or my legal representatives forever release, waive, discharge and covenant not to sue NOURISH, Nourish Incorporated, their agents, or their heirs for any injury, damage, or death caused by their negligence or any other act. I specifically agree that NOURISH, Nourish Incorporated, their agents, and heirs shall not be liable for any claim, demand, cause of action of any kind, whatsoever for, or on account of death, personal injury, property damage, or loss of any kind resulting from or related to my use of 130 Walnut Avenue, Santa Cruz, CA or participation in any exercise, yoga, or other activity within or without the premises and agree to hold NOURISH, Nourish Incorporated, their agents, and heirs harmless from same.

NOURISH, Nourish Incorporated agrees to keep all information provided by me confidential and not share it with anyone except for the purposes enumerated in this contract.

I have read the above Contract and fully understand its contents. I voluntarily agree to the terms and conditions stated in this document. I agree that the information provided is true and correct to the best of my knowledge and that if any information changes NOURISH, Nourish Incorporated will be notified in writing immediately.
